The Claremont Institute Condemns the Disbarment of John Eastman


The Claremont Institute denounces the California State Bar’s decision to disbar Dr. John C. Eastman, founding director of our Center for Constitutional Jurisprudence, and a constitutional scholar of the highest order.

Dr. Eastman’s advocacy concerning the conspicuous constitutional irregularities in the 2020 presidential election was conducted within the bounds of well-established legal practice and the Constitution itself. Punishing him for offering legal counsel on these matters is a chilling attack on the core freedoms that safeguard our republic.

“This goes far beyond my own bar license,” emphasized Eastman. “What we’re facing is a calculated leftist capture of America’s core institutions—legal, academic, and beyond—which are now being systematically weaponized to silence and destroy any voice daring to oppose the entrenched administrative state.”

Throughout the years, Dr. Eastman has led the CCJ in hundreds of  amicus curiae briefs before the Supreme Court of the United States, defending fundamental principles of the American Founding. His contributions include advocacy in landmark cases on religious liberty (Burwell v. Hobby Lobby Stores, Inc.), federalism (NFIB v. Sebelius), and the defense of the Second Amendment (McDonald v. City of Chicago). He has also advanced the cause of free association and speech rights, submitting arguments that have shaped constitutional thought nationwide.

“Dr. John C. Eastman has been a fearless champion  of the Center for Constitutional Jurisprudence’s mission to restore the constitutional design envisioned by our nation’s founders,” stated Claremont Institute President Ryan Williams. “Recently, John has been subjected to profoundly un-American lawfare, and his disbarment is an egregious and illegitimate abuse that should alarm anyone who believes in due process, fairness, and the rule of law. The advocates and institutions of such lawfare conduct themselves with an immoderation that, if left unchecked, could unravel our civic order.”

The Claremont Institute calls upon the legal community, elected officials, and concerned citizens alike to denounce this misuse of disciplinary power. We urge the Supreme Court of the United States to take note of this escalating assault on free expression and the independence of the bar.
