The Claremont Institute's Center for Constitutional Jurisprudence filed an important brief on behalf of itself, the Cato Institute, and the American Civil Rights Union in support of the lawsuit filed by Wheaton College and Belmont Abbey College.
The case challenges the constitutionality of new contraception and abortion coverage mandates imposed by the Department of Health and Human Services as part of its Obamacare implementation regulations. Those mandates will require the colleges to provide insurance coverage for their employees for services that violate the fundamental religious tenents of the colleges.
The district court had held that the religiously-affiliated colleges did not have legal standing to challenge the mandates, because HHS has announced that it might consider changing the regulations in the future. The Center's hard-hitting brief challenges the Executive branch's efforts to immunize its unconstitutional regulations from judicial review.
