In-State Tuition for Illegal Immigrants

In 1996, Congress passed a law prohibiting states from charging lower tuition rates for in-state illegal immigrants than they charge to out-of-state U.S. Citizens. Despite the law, a number of States, including California, Texas, Kansas, and New York, give this significant reduced tuition benefit to illegal immigrants but not to U.S. citizens. Recent litigation in all four states is challenging these illegal state policies.
