Dr. John Eastman, Director of the Center for Constitutional Jurisprudence, is scheduled to be on CNN with Paula Zahn this evening sometime between 5 and 6 p.m. Pacific time, 8 and 9 p.m. Eastern, discussing his recent congressional testimony on birthright citizenship.
As Eastman explained in a recent exchange in the editorial pages of the Wall Street Journal, the Constitution's Citizenship Clause has been misinterpreted as conferring automatic citizenship on anyone born on U.S. soil, even to parents who owe allegiance to a foreign nation and even to parents who are in the U.S. illegally. The 14th Amendment actually provides that "all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens." As the authors of the Amendment made clear, the words of the "jurisdiction clause" means those subject to the complete and exclusive jurisdiction of the United States, and not owing allegiance to any foreign power.
